Court Date Set For Broomfield Fracking Vote Count (Update: Hearing Delayed)

Updated: A Dec. 18 district court hearing had been set to hear a case between Broomfield election officials and a pro-fracking group over voting irregularities with a 5-year fracking moratorium that voters narrowly approved. It has been delayed pending another case.

Update 4:21 p.m. 12/17/13 - A Broomfield district court judge has postponed the hearing pending the outcome of Hanlen v. Gessler, which is expected to be heard within the next week.

Broomfield election officials following a recount. According to a motion to decertify Question 300, the Broomfield Balanced Energy Coalition requested access to election-related materials like ballot logs which were 鈥渆ither partially responded to or not responded to at all.鈥�

This is the latest development in a long, protracted battle over voting irregularities.

In November, the Colorado Secretary of State issued a report criticizing how Broomfield election officials handled the original vote count. [.pdf] concluded that the Clerk鈥檚 office committed 鈥渟everal errors in conducting the election.鈥�

The Dec. 18 hearing could decide whether BBEC gains access to certain documents, and whether the election results remain uncertified.
